Article 1 – Purpose
These General Terms and Conditions of Use (hereinafter referred to as "the General Terms and Conditions"). « CGU ») are intended to define the arrangements for making the site available nopalrestaurant.fr (hereinafter: « the Site ») and the conditions of use by the user.
Article 2 – Access to the site
The Site presents the restoration activity of the Nopal. Access is free for any user with Internet access. The publisher tries to keep the site accessible 24 hours a day, but may interrupt access for maintenance or update without notice.
Article 3 – Description of services
The Site allows the user to:
- See the menu of dishes, drinks and menus.
- View Events
- See opening hours and practical information.
- Make an online booking request. Note: The pictures of the dishes are not contractual. Rates are subject to change depending on seasonality and arrivals.
Article 4 – Use of the site
The user undertakes a normal use of the site. It prohibits inter alia:
- Any action of « scraping » or automatic data retrieval.
- Any malicious use (virus, attempted intrusion).
- Use of the reservation form for abusive shipments (spam).
Article 5 – Intellectual property
All contents (texts, photos, logo, design) are the property of Mr Emmanuel Leroy or restaurant Nopal. Any reproduction, even partial, without written authorisation is a forgery.
Article 6 – Online reservations (Zenchef)
Online reservation service is provided by our partner Zenhead.
- Responsibility: The Nopal restaurant cannot be held responsible for technical malfunctions, errors in availability or interruptions of the reservation service dependent on the Zenchef platform.
- Process: By clicking on the booking button, the user is either redirected to the Zenhead interface or uses an integrated module (widget).
- Personal data: The data entered during the reservation (name, phone, email) is collected by Zenchef on behalf of the restaurant Nopal in order to manage the reservation.
- Partner conditions: The use of this service may be subject to Zenchef's own Terms of Use and Privacy Policy.
Article 7 – Personal data
Information collected via contact or reservation forms is processed in accordance with our Privacy Policy. They are used exclusively to manage your table or to meet your requests. You have a right of access and rectification by contacting: restaurantnopal@gmail.com
Article 8 – Cookies
The Site uses cookies that are essential to the operation and audience measurement cookies (Google Analytics). The user can manage his preferences via the cookie banner on his first visit.
Article 9 – Liability
The Nopal restaurant makes every effort to disseminate accurate information. However, the restaurant cannot be held responsible for:
- Damage caused by a computer virus transmitted via the Internet.
- Discontinuation of a product on the map.
- Technical error on the third party booking module.
Article 10 – Hypertext links
The Site may contain links to external sites.
The publisher has no control over these sites and cannot be held responsible for their content or privacy policy.
Article 11 – Applicable law
These GUCs are governed by French law. In the absence of an amicable agreement, any dispute relating to the interpretation or performance of the present shall be brought before the competent courts of Charts.
Article 12 – Modification of EGUs
The publisher reserves the right to modify these Terms and Conditions at any time.
The changes take effect as soon as they are posted on the Site.
